Subcontracting (or “black work”) is a major offense. Every person in the kitchen or dining room must have completed a DPAE (Prior Employment Declaration) BEFORE starting, even for a one-hour trial.
Family support: Tolerated for the spouse or children on a sporadic and voluntary basis, but heavily regulated. If they are there every day, they must be employed or partners.
Staff meals (Benefits in Kind): Must appear on the payslip and be subject to contributions. Not declaring them is a common reassessment.
Tips: Since 2022, tips paid by card are exempt from social security and tax charges (subject to a salary ceiling).
