Current status: the majority of delivery drivers are independent workers (micro-entrepreneurs). They are not your employees nor those of the platform.
Your responsibility, as a restaurateur, ends with handing the order to the delivery person. After that, it’s the responsibility of the platform and the delivery person.
However, if a food safety issue is identified (poorly packaged dish, temperature not respected), your liability may be incurred even after delivery.
Regulatory evolution: Several European countries are reclassifying delivery drivers as salaried. If this happens in France, platform commissions could increase.
Our advice: diversify your sales channels. Don’t rely 100% on platforms. Develop direct ordering (website, telephone) to reduce your exposure.
